Terms and Conditions

Welcome to Hanim Exports. These Terms and Conditions (“Terms”) govern all exports, sales, and business transactions carried out by us as a spice exporter from India to customers across the world. By engaging in trade with us, you (“Buyer/Client”) agree to comply with the following terms.

1. General

These Terms apply to all quotations, invoices, purchase orders, and export agreements unless otherwise agreed in writing. Any changes to these Terms must be mutually approved in writing. Our products are intended for food, culinary, and related purposes only, unless specified otherwise.

2. Products and Quality

We export black pepper, cardamom, cloves, fenugreek, cinnamon, and other agreed spices in compliance with FSSAI, ISO, HACCP, and applicable international standards. While we ensure strict quality control, natural variations in size, color, and aroma may occur, as spices are agricultural products. Samples, if provided, are indicative and not guaranteed to match the final bulk shipment exactly.

3. Pricing and Payment

All prices are quoted in USD/INR or mutually agreed currency and are exclusive of taxes, duties, and freight unless otherwise stated. Payment terms must be agreed before shipment. Common methods include advance payment, Letter of Credit (LC), or bank transfer. Orders will be processed only after receiving confirmation of payment as per the agreed terms.

4. Order, Shipping, and Delivery

Minimum Order Quantity (MOQ) and delivery timelines vary depending on the product and destination. Delivery terms are based on Incoterms (FOB, CIF, CFR, EXW, etc.) agreed in the contract. We are not responsible for delays caused by customs clearance, port congestion, natural disasters, or other events beyond our control. Risk and ownership of goods transfer to the Buyer once the shipment is handed over to the carrier/shipping agent.

5. Packaging and Labeling

Spices are packed in export-quality, food-safe packaging to preserve freshness. Customized packaging and private labeling are available upon request and may involve additional charges. The Buyer is responsible for ensuring compliance with import packaging/labeling regulations in their country.

6. Import, Customs, and Compliance

Buyers are responsible for securing import licenses, permits, and approvals required in their country. We are not liable for shipments delayed, seized, or rejected due to non-compliance with the Buyer’s local regulations. All exports comply with Indian export laws and international trade regulations.

7. Returns, Claims, and Liability

Claims for quality, shortage, or damage must be reported within 7 days of delivery with supporting documentation. Returns are accepted only if mutually agreed and subject to inspection. Our liability is limited to the value of the goods supplied and does not extend to indirect, incidental, or consequential losses.

8. Confidentiality and Intellectual Property

All contracts, pricing, and business information exchanged between both parties must remain confidential. Use of our brand name, logo, or marketing materials without prior consent is strictly prohibited.

9. Governing Law and Jurisdiction

These Terms are governed by the laws of India, subject to jurisdiction of the courts in Coimbatore, Tamil Nadu, India. Any disputes will be resolved through negotiation, failing which arbitration may be conducted as per the Arbitration and Conciliation Act, 1996 (India).

10. Amendments

We reserve the right to update or modify these Terms at any time. Updated Terms will be effective immediately upon posting on our website or notifying the Buyer.
